Unfunded Liability Now “Trite Law”? – 18-006253 v Allstate: Despite a proclamation by the adjudicator in an unpublished decision released August 21, 2019 submitted by Samia Alam from Bartolini Berlingieri Barrafato Fortino LLP, there does not yet appear to be universal agreement that CAT assessments are (a) not included in available medical/rehabilitation benefits, and (b) can be proposed at any time, with no applicable limitation period.
